DMCA Policy

SparkMeAI respects the intellectual property rights of others and expects users of the platform to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), SparkMeAI will respond to properly submitted copyright infringement notices and may remove or disable access to allegedly infringing material where appropriate.

1. Copyright Infringement Notification

If you believe that content available through SparkMeAI infringes your copyright, you may submit a DMCA notice containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  2. Identification of the material that is claimed to be infringing and sufficient information to locate the material on SparkMeAI, such as a URL, character name, screenshot, message ID, media ID, or other location information.
  3. Your name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the disputed material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

SparkMeAI may request additional information when necessary to process a claim.

3. Counter-Notification

If you believe that content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
  2. Your name, mailing address, telephone number, and email address.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which SparkMeAI may be found, and that you will accept service of process from the person who submitted the original DMCA notice or that person's agent.
  5. Your physical or electronic signature.

Counter-notifications may be submitted to support@sparkmeai.com with the subject line "DMCA Counter Notice".

4. Response to Notices and Counter-Notices

After receiving a valid DMCA notice, SparkMeAI may remove or disable access to the allegedly infringing material and notify the affected user where appropriate. After receiving a valid counter-notification, SparkMeAI may restore the removed material unless the original complaining party notifies us that it has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material. SparkMeAI may decline incomplete, invalid, abusive, or bad-faith notices.

5. Repeat Infringer Policy

SparkMeAI may suspend or terminate accounts that are determined to be repeat copyright infringers. We may also remove content, restrict access, disable features, or take additional actions where appropriate.

6. AI-Generated Content

SparkMeAI provides content generated or assisted by artificial intelligence systems. While AI-generated content may not always be based on copyrighted works, SparkMeAI will review copyright complaints submitted in accordance with applicable law. Where appropriate, content may be removed, restricted, disabled, or otherwise addressed following review.

7. Misrepresentations

Any person who knowingly misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages under applicable law. SparkMeAI reserves the right to reject fraudulent, abusive, or bad-faith copyright complaints.

8. Limitation of Liability

SparkMeAI acts as an online service provider and does not guarantee the legality, originality, or ownership status of all content generated, uploaded, or displayed through the platform. Nothing in this policy creates obligations beyond those required by applicable law.

9. Changes to This Policy

SparkMeAI may update this DMCA Policy at any time. Updated versions will be published on SparkMeAI.com or otherwise made available through the Service. Continued use of the platform after changes become effective constitutes acceptance of the revised policy.
