Welcome to SparkMeAI.com ("SparkMeAI", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of SparkMeAI, including our website, applications, AI characters, chat features, generated content, premium features, virtual credits, media features, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not access or use the Service.

1. Eligibility and Age Requirement

SparkMeAI is intended exclusively for adults. You may access or use the Service only if:

  • You are at least 18 years old;
  • You are at least the age of majority in your jurisdiction, if higher than 18;
  • You are legally permitted to access adult-oriented or mature content in your jurisdiction;
  • You have the legal capacity to agree to these Terms.

By using SparkMeAI, you represent and warrant that you satisfy these requirements. We may suspend, restrict, or terminate access if we believe a user is underage or has provided false age-related information.

2. Service Description

SparkMeAI is an AI-powered virtual companion platform that may provide:

  • AI chat and roleplay experiences;
  • Fictional AI characters;
  • AI-generated or AI-assisted text, images, videos, voice messages, and other media;
  • Premium membership features;
  • Virtual credits, including Sparks;
  • Unlockable or restricted media features;
  • Other interactive AI experiences.

The Service is provided for entertainment, creative, roleplay, and virtual companionship purposes only. SparkMeAI is not intended to provide medical, mental health, legal, financial, professional, or emergency advice.

3. AI Characters Are Fictional

All AI characters available through SparkMeAI are fictional virtual characters. AI characters:

  • Are not real people;
  • Do not possess consciousness, feelings, emotions, or independent intent;
  • Do not form real personal relationships;
  • Do not make real-world commitments;
  • Do not exist outside of the Service.

Any personality, affection, memory, opinion, relationship development, or emotional expression presented by an AI character is part of a simulated fictional experience. You should not rely on AI character output as factual, professional, or life-critical information.

4. AI-Generated Content

The Service may generate or assist in generating text, images, videos, voice messages, and other content ("AI-Generated Content"). AI-Generated Content may:

  • Be inaccurate, incomplete, inconsistent, or unexpected;
  • Contain fictional, mature, romantic, suggestive, or adult-oriented material;
  • Fail to reflect real facts or real-world events;
  • Differ from user expectations or prompts.

We do not guarantee the accuracy, reliability, availability, suitability, originality, or legality of any AI-Generated Content. You are responsible for how you use, save, share, or rely on AI-Generated Content.

5. Human Assistance and Moderation

To operate, improve, secure, and enforce the Service, SparkMeAI may use automated systems, human moderation, human review, customer support personnel, and human-assisted operational processes. Authorized personnel may access certain account information, user content, chat records, generated content, or usage information when reasonably necessary for customer support, safety, abuse prevention, legal compliance, service improvement, or platform operations.

6. Accounts and Security

You may need an account to access certain features. You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • Keeping your login methods secure;
  • All activities that occur under your account;
  • Promptly notifying us of unauthorized access or security concerns.

You may not sell, transfer, share, or assign your account without our prior permission. We may suspend or restrict accounts that appear compromised, fraudulent, abusive, or in violation of these Terms.

7. Premium Memberships, Subscriptions, and Paid Features

SparkMeAI may offer paid features, including premium memberships, subscriptions, virtual credits, media unlocks, or other digital benefits. Premium features may include, depending on the plan and availability:

  • Additional Sparks or recurring Spark grants;
  • Access to premium or restricted content;
  • Access to media generation or media unlock features;
  • Enhanced chat, voice, image, video, or character features;
  • Other benefits described at the time of purchase.

Plan details, pricing, billing periods, included benefits, renewal terms, and restrictions will be presented in the product interface or checkout flow. Some subscriptions may renew automatically unless canceled before the renewal date. You are responsible for reviewing the terms, price, billing cycle, renewal terms, and included benefits before completing a purchase.

8. Sparks, Virtual Credits, and Digital Items

Sparks and other virtual items:

  • Are digital, limited, revocable rights to access specific in-service features;
  • Have no cash value;
  • Are not legal tender, currency, property, stored value, or monetary instruments;
  • May not be sold, transferred, exchanged, redeemed for money, or traded outside the Service unless we expressly allow it;
  • May expire, be limited, or be adjusted according to the applicable plan, promotion, or product rules.

We may modify, suspend, revoke, or limit virtual credits or digital items where necessary for fraud prevention, legal compliance, abuse prevention, technical issues, chargebacks, refunds, or violation of these Terms.

9. Redeem Codes and Promotions

Redeem codes and promotions:

  • May be subject to eligibility requirements, expiration dates, quantity limits, and usage restrictions;
  • May not be sold, transferred, duplicated, or abused;
  • May be revoked if obtained or used fraudulently;
  • May be modified or discontinued where permitted by law.

We may reject, cancel, or reverse benefits from invalid, expired, unauthorized, duplicated, or abusive redemption activity.

10. Payments, Refunds, and Cancellations

Payments may be processed by third-party payment providers. Unless otherwise required by law or expressly stated at purchase:

  • Purchases of digital content, virtual credits, redeemable benefits, and premium features are final;
  • Paid features are non-refundable;
  • Virtual credits and digital items are non-transferable;
  • Partial billing periods may not be refunded.

If you cancel a subscription, cancellation will generally stop future renewal charges but may not refund amounts already charged, unless required by law or stated otherwise at the time of purchase.

11. Acceptable Use

You agree not to use the Service to create, request, upload, distribute, promote, or assist with content or activity that:

  • Is unlawful, fraudulent, deceptive, defamatory, threatening, harassing, hateful, or abusive;
  • Involves minors in any sexual, suggestive, exploitative, abusive, or harmful context;
  • Depicts or promotes non-consensual intimate content;
  • Misuses another person's identity, likeness, private information, or personal data;
  • Infringes copyright, trademark, privacy, publicity, or other rights;
  • Promotes violence, self-harm, exploitation, coercion, or illegal activity;
  • Attempts to bypass safety systems, moderation, access controls, rate limits, payment systems, or technical restrictions;
  • Scrapes, extracts, copies, reverse engineers, overloads, or disrupts the Service;
  • Violates any applicable law or regulation.

12. Adult and Mature Content

The Service may include mature, romantic, suggestive, fictional, or adult-oriented AI-generated content. You are solely responsible for determining whether accessing such content is legal and appropriate in your jurisdiction. You may not use the Service to generate, upload, request, or distribute illegal adult content, non-consensual intimate content, content involving real minors, or content depicting any person who appears to be a minor in sexual contexts.

13. User Content

By submitting User Content, you grant SparkMeAI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, modify, display, transmit, create derivative works from, and use your User Content as reasonably necessary to provide and operate the Service, generate AI outputs, provide customer support, enforce these Terms, and comply with legal obligations.

You represent and warrant that you have all rights, permissions, and legal authority necessary to submit your User Content and grant this license.

14. Generated Content Rights

Subject to your compliance with these Terms and applicable law, you may use AI-Generated Content made available to you through the Service for personal, non-commercial purposes unless we state otherwise. SparkMeAI does not guarantee that AI-Generated Content is unique, protectable, non-infringing, or available for exclusive use.

15. Media Unlocks and Private Content Features

Access to restricted or unlockable features may require a premium membership, Sparks or other virtual credits, and compliance with these Terms. Unlocking content grants only limited in-service access. It does not grant ownership of the underlying content, character, media asset, platform software, or related intellectual property.

16. Intellectual Property

SparkMeAI and its licensors own all rights, title, and interest in the Service, including software, platform design, branding, trademarks, logos, character systems, AI systems, databases, documentation, and service content. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service or any part of it.

17. Copyright and Content Removal

If you believe content on the Service infringes your copyright, violates your privacy, misuses your likeness, or otherwise violates applicable rights, you may submit a request under our DMCA Policy, Content Removal Procedures, Underage Policy, or AI Character Policy.

18. Account Deletion

You may request deletion of your account through available account tools or by contacting support. After account deletion, your access to the account may be terminated, personal information may be deleted or anonymized, and certain records may be retained where necessary for legal compliance, billing, fraud prevention, or dispute resolution. Deletion may be irreversible and may result in loss of subscriptions, Sparks, chat history, unlocked content, and other account data.

19. Service Availability and Changes

We may modify, suspend, discontinue, restrict, or remove any part of the Service at any time, including characters, plans, virtual credit rules, media features, AI models, pricing, usage limits, and platform functionality. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

20. Third-Party Services

The Service may include links, integrations, payment processors, hosting providers, analytics tools, authentication providers, or other third-party services. Third-party services are governed by their own terms and policies. SparkMeAI is not responsible for third-party services, content, policies, failures, or practices.

21. Termination and Enforcement

We may suspend, restrict, or terminate your account or access to the Service if you violate these Terms or our policies, your activity creates legal or safety risk, we are required to do so by law, or your account is involved in payment issues or abuse. Termination may result in loss of access to your account, Sparks, subscriptions, content, and other digital benefits.

22. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SparkMeAI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

23. Limitation of Liability

To the maximum extent permitted by law, SparkMeAI and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages. SparkMeAI's total liability for any claim will not exceed the amount you paid to SparkMeAI during the three months before the event giving rise to the claim, or USD $100, whichever is greater.

24. Indemnification

You agree to defend, indemnify, and hold harmless SparkMeAI and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of law.

25. Governing Law and Dispute Resolution

These Terms will be governed by the laws of [JURISDICTION]. You and SparkMeAI agree to first attempt to resolve disputes informally by contacting support@sparkmeai.com.

26. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on SparkMeAI.com or otherwise made available through the Service. Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
