SparkMeAI.com ("SparkMeAI") is an AI-powered virtual companion platform that provides AI-generated and AI-assisted content, including text, images, videos, voice interactions, fictional characters, and other digital experiences. This statement explains SparkMeAI's position regarding the record-keeping requirements of 18 U.S.C. § 2257, 18 U.S.C. § 2257A, and 28 C.F.R. Part 75.
1. AI-Generated and Fictional Content
SparkMeAI does not create, produce, contract for, manage, or publish visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct as those terms are used in 18 U.S.C. § 2257 and related regulations.
Characters, conversations, images, videos, and other content made available through SparkMeAI are intended to be:
- Artificially generated by computer systems and artificial intelligence technologies;
- Fictional and digitally created;
- Not depictions of real persons;
- Not produced using actual performers engaged in sexually explicit conduct.
Accordingly, SparkMeAI understands that its AI-generated fictional content is not subject to the record-keeping requirements applicable to producers of visual depictions of actual human performers engaged in sexually explicit conduct.
2. No Real Human Performers
SparkMeAI does not employ, contract with, film, photograph, or record human performers for the purpose of producing sexually explicit visual content. Any appearance of persons within AI-generated content provided by SparkMeAI is intended to be fictional and computer-generated. No actual human models, actors, or performers are intended to be depicted in AI-generated content provided by SparkMeAI.
3. User-Uploaded Content
Where user-uploaded content is permitted, users are solely responsible for ensuring that such content complies with all applicable laws, regulations, and platform policies. Users may not upload, request, generate, distribute, or promote content that:
- Depicts actual human performers engaged in sexually explicit conduct without required legal compliance;
- Depicts or involves minors in sexual, suggestive, exploitative, abusive, or harmful contexts;
- Misuses another person's likeness, image, voice, or identity without authorization;
- Violates consent, age-verification, copyright, privacy, publicity, or other legal requirements.
SparkMeAI may remove content, restrict access, suspend accounts, preserve records, and cooperate with appropriate authorities where necessary or required by law.
4. Prohibited Content Involving Minors
SparkMeAI maintains a strict zero-tolerance policy regarding content involving minors. Users may not:
- Generate content depicting minors in sexual or suggestive situations;
- Request content involving minors in sexual, exploitative, abusive, or harmful contexts;
- Upload content involving minors in prohibited contexts;
- Attempt to circumvent platform safeguards related to age restrictions or minor safety.
Any violation may result in immediate account termination, removal or restriction of content, preservation of relevant records, and reporting to law enforcement or appropriate authorities where required or appropriate.
5. Age Restriction
SparkMeAI is intended exclusively for adults. Users must be at least 18 years old, or the age of majority in their jurisdiction, whichever is higher. By accessing the platform, users represent and warrant that they satisfy these age requirements and are legally permitted to access adult-oriented or mature content in their jurisdiction.
6. Content Review and Removal
If SparkMeAI becomes aware of content that may involve actual human performers, minors, non-consensual intimate content, unlawful content, or content requiring additional compliance review, SparkMeAI may remove or restrict the content while reviewing the matter.
